A second source within the Italian government also confirmed to The Daily Beast that Barr and Durham were shown other evidence the Italians had on Mifsud. Ever since Robert Mueller concluded his probe in March 2019, Barr has worked to blunt its impact—and investigate the investigators behind it. Barr assigned Durham to look into the Mueller probe’s origins. And the Attorney General’s name is listed in the whistleblower complaint about the July 25 call Trump made to the Ukrainian president to pressure him into investigating political rival Joe Biden. According to the complaint, Barr was directly involved in the president’s attempt to “solicit interference from a foreign country in the 2020 U.S. election.” The minutiae of his involvement are feeding a scandal gripping Washington that changes by the nano-second.

Federal prosecutors have accused Donald Trump‘s former national security advisor Michael Flynn of making frivolous document production requests that are not actually related to his defense at all but are instead an attempt to fuel outrage by spreading conspiracy theories about the Russiagate investigation. And one of those theories was allegedly suggested by Rep. Devin Nunes (R-CA). In a 41-page motion filed with the U.S. District Court for the District of Columbia on Tuesday, U.S. Attorney Jesse K. Liu and her top lieutenants Brandon Van Granck and Jocelyn Ballantine argued that Flynn’s recent request for potentially exculpatory evidence known as Brady material is a sideshow with no genuine legal bearing on his case–which is currently in a very slow-drip sentencing phase. “The defendant predicates much of his request on conspiracy theories, demanding that the government engage in a fishing expedition for documents that could offer support for those theories,” the filing alleges. “Irrespective of whether such documents exist, a fact that the government does not concede here, the defendant fails to establish that such information is relevant—let alone favorable and material—in this criminal case.”

A government watchdog group asked a federal judge on Tuesday to issue an emergency order requiring the White House to preserve records of all of President Donald Trump’s calls with foreign leaders. At a court hearing later in the day, a Justice Department lawyer told the judge that she couldn’t immediately commit to assuring that the administration would preserve records of all of Trump’s conversations, as well as other records about how the administration had handled those documents. The judge gave the government until Wednesday afternoon to make a decision. The case, which accuses the Trump administration of failing to meet its legal obligations to create — and properly save — records of Trump’s and other officials’ conversations with foreign leaders, was originally filed in May. But the plaintiffs are now arguing that the judge needs to take immediate action in light of recent events.

The pro-Trump effort said Tuesday that it has raised more than $308 million in 2019 and has more than $156 million in the bank. The McCutcheon case has completely changed presidential-level fundraising in that time: The Supreme Court on Wednesday continued its abolition of limits on election spending, striking down a decades-old cap on the total amount any individual can contribute to federal candidates in a two-year election cycle.
The ruling, issued near the start of a campaign season, will very likely increase the role money plays in American politics. The 5-to-4 decision, with the court’s more conservative members in the majority, echoed Citizens United, the 2010 decision that struck down limits on independent campaign spending by corporations and unions.

A federal judge ruled Tuesday that Harvard University does not discriminate against Asian Americans in undergraduate admissions, handing the school a victory in a lawsuit that marks one of the latest chapters in the affirmative action debate. U.S. District Judge Allison D. Burroughs rejected claims of a plaintiff that Harvard violates the law as it considers race in selecting an incoming freshman class. While Harvard’s “admissions process may be imperfect,” Burroughs wrote, the judge concluded that statistical disparities among racial groups of applicants “are not the result of any racial animus or conscious prejudice.” The judge also found that Harvard “narrowly tailored” its use of race in admissions to achieve the benefits of a diverse class.

Two Republicans, one of them former congressman Bob Inglis, have sued the S.C. Republican Party over its decision to cancel its GOP presidential primary next year. The lawsuit, filed Tuesday in Richland County, alleges the party scrapped their 2020 election contest illegally and violated its own party rules and state election law. The suit further contends the near-unanimous decision made by the state party’s Executive Committee deprives Inglis, of Greenville, and fellow plaintiff Frank Heindel of Mount Pleasant, of their right to vote for the candidate of their choosing in the 2020 primary. “Instead, the State Executive Committee has chosen which candidate to support by fiat, and in doing so, excluded Republican voters from the process entirely — in violation of the law and its own rules,” the lawsuit states.
