"If conservatives become convinced that they can not win democratically, they will not abandon conservatism. The will reject democracy." ― David Frum, Trumpocracy: The Corruption of the American Republic
Four states are poised to cancel their 2020 GOP presidential primaries and caucuses, a move that would cut off oxygen to Donald Trump’s long-shot primary challengers. Republican parties in South Carolina, Nevada, Arizona and Kansas are expected to finalize the cancellations in meetings this weekend, according to three GOP officials who are familiar with the plans. The moves are the latest illustration of Trump’s takeover of the entire Republican Party apparatus. They underscore the extent to which his allies are determined to snuff out any potential nuisance en route to his renomination — or even to deny Republican critics a platform to embarrass him. Trump advisers are quick to point out that parties of an incumbent president seeking reelection have a long history of canceling primaries and note it will save state parties money. But the president’s primary opponents, who have struggled to gain traction, are crying foul, calling it part of a broader effort to rig the contest in Trump’s favor. “Trump and his allies and the Republican National Committee are doing whatever they can do to eliminate primaries in certain states and make it very difficult for primary challengers to get on the ballot in a number of states,” said former Rep. Joe Walsh (R-Ill.), who recently launched his primary campaign against the president. “It’s wrong, the RNC should be ashamed of itself, and I think it does show that Trump is afraid of a serious primary challenge because he knows his support is very soft.”

A group of anonymous investors who claim that Donald Trump defrauded them by endorsing a marketing company that went bust will get to seek evidence in the case, even as Trump tries to have the lawsuit heard by an arbitrator. U.S. District Judge Lorna Schofield on Thursday allowed the four plaintiffs to seek documents and testimony of witnesses while they fight Trumps’s bid to have them resolve their claims directly with the company, ACN Inc. The investors have said that while they agreed to arbitration with the company, they didn’t consent to such an arrangement with Trump. Trump and his three oldest children were sued for their role in promoting ACN for a decade through comments, pitches on “Celebrity Appearance” and live company events. The company’s flagship product was a desktop video phone that could only connect calls between two ACN customers and which was quickly eclipsed by services like Skype and the advent of smartphones, according to the complaint, which alleges the plaintiffs lost hundreds of thousands of dollars by putting their faith in the Trumps.

USCIS Head Cuccinelli Unlawfully Appointed by Trump, Lawsuit Says | Trump skirted the law when he appointed Kenneth T. Cuccinelli II as one of his administration’s top immigration officials, and certain actions by Cuccinelli’s office should have no force or effect, according to a new lawsuit. The complaint was submitted to the U.S. district court for the District of Columbia Friday by the Democracy Forward Foundation, Proskauer Rose LLP, Catholic Legal Immigration Network, Inc., and the Refugee and Immigrant Center for Education and Legal Services. It challenges three directives from U.S. Citizenship and Immigration Services, both based on their substance and because of the “unlawful acting official” who issued them.

'This is your job, not ours': O'Rourke campaign, stung by Twitter smear, implores tech firms to erase disinformation | Beto O’Rourke’s presidential campaign sent letters to major technology companies Friday morning imploring them to do more to root out disinformation ahead of the 2020 election. The pointed appeals, from campaign manager Jen O’Malley Dillon, came after a conspiracy theory falsely linking the former Texas congressman to the gunman who killed seven people in two west Texas towns on Saturday was allowed to spread on social media this week, garnering thousands of shares and, according to the campaign, at one point becoming the second-highest-trending Google search query related to the candidate in the preceding seven days. Among those who amplified the deceptive claim, which appeared to originate on Twitter with the charge that the gunman was a democratic socialist with an O’Rourke sticker on his truck, were Anthony Shaffer, a former Defense Intelligence Agency officer and member of an advisory board whose mission is to promote President Trump, and Sebastian Gorka, who worked briefly in the White House. Otherwise, many of the accounts that promoted the falsehoods exhibited botlike characteristics, according to analysts. Nir Hauser, the chief technology officer at VineSight, which uses artificial intelligence to track misinformation, said the original tweet received a first boost from accounts that behaved like bots, a type of software that can be set up to push messages on social media. After briefly suspending the instigating account, which operates under the handle @suemo54 and the name “Sue Moore,” Twitter said Thursday it would not remove the posts because they do not violate the company’s policies.

US Beekeepers File Suit Against Trump EPA Charging 'Illegal' Approval of Insecticide Linked to Mass Die-Off | Honeybees and other pollinators are dying in droves because of insecticides like sulfoxaflor, yet the Trump administration removes restriction just to please the chemical industry. | The lawsuit (pdf) charges that the EPA's approval of sulfoxaflor—touted by its manufacturer, agro-chemical giant Corteva, as a "next generation neonicotinoid"—was illegally rendered as it put industry interests ahead of the health of pollinators and ignored the available science. | EPA first approved sulfoxaflor in 2013, but thanks to a lawsuit brought by Pollinator Stewardship Council, the American Beekeeper Federation, and Earthjustice, the Ninth Circuit Court of Appeals overturned that decision. The Court ruled EPA failed to obtain reliable studies regarding the impact of sulfoxaflor on honeybee colonies. In 2016, EPA re-approved sulfoxaflor subject to significant restrictions to reduce the risk to honeybees and other pollinators. On July 12, 2019, without any public notice, the Trump administration removed these restrictions on sulfoxaflor and approved a host of new uses for the bee-killing insecticide.

"From Rio de Janeiro and Brasilia to San Francisco and Hong Kong, people across generations, backgrounds, and borders are expressing their outrage over the destructive fires and their solidarity with the determined efforts of indigenous peoples to defend the forest and our collective wellbeing," said Christian Poirier, program director at Amazon Watch, which coordinated the global actions alongside the Association of Indigenous Peoples of Brazil (APIB) and Extinction Rebellion. The demonstrations, which spanned more than 20 countries, came as thousands of fires continued to devastate the Amazon rainforest. Many of the blazes were deliberately and illegally set by farmers, loggers, and ranchers who, according to critics, have been emboldened by Bolsonaro's aggressive support for deforestation, which was accelerated rapidly during his time in office. "Thousands of people around the world are mobilizing alongside Brazil's resistance to the Bolsonaro regime," said Poirier.

The Justice Department has launched an "antitrust investigation" of four leading automakers over an agreement they forged with the state of California to maintain higher fuel efficiency standards than those sought by the Trump administration, according to one of the companies. | The Justice Department inquiry, first reported by the Wall Street Journal, escalates the stakes in the long-running battle between Trump officials and those in California, who have repeatedly asserted the state’s right to establish guidelines for tailpipe emissions given its exemption under the Clean Air Act.

A Salvadoran woman who was eight and a half months pregnant and experiencing contractions was apprehended by US border patrol after crossing the Rio Grande and forced to go back to Mexico. Agents took her to the hospital, where doctors gave her medication to stop the contractions. And then, according to the woman and her lawyer, she was almost immediately sent back to Mexico. There, she joined the more than 38,000 people forced to wait across the border for immigration court hearings under a rapidly expanding Trump administration policy. And her plight highlights the health risks and perils presented by the Remain in Mexico program. The woman was waiting on Thursday with her three-year-old daughter in a makeshift tent camp in Matamoros, Mexico, next to an international bridge, due to give birth any day, said her attorney, Jodi Goodwin. “She’s concerned about having the baby in the street or having to have the baby in a shelter,” Goodwin said.

Perhaps one of the clearest and ugliest gerrymanders in North Carolina—or in the entire nation—is the congressional-district line that cuts in half the nation’s largest historically black college, North Carolina A&T State University, in Greensboro. The district line divided this majority minority campus—and the city—so precisely that it all but guarantees it will be represented in Congress by two Republicans for years to come. North Carolina Republicans have long denied that this line, between the state’s Sixth and Thirteenth Congressional Districts, was intentionally drawn to dilute black voting power, which would be a violation of the constitutional prohibition against racial gerrymandering. Hofeller’s files, though, show that he created giant databases that detailed the racial makeup, voting patterns, and residence halls of more than a thousand North Carolina A&T students. He also collected similar data that tracked the race, voting patterns, and addresses of tens of thousands of other North Carolina college students. Some spreadsheets have more than fifty different fields with precise racial, gender, and geographic details on thousands of college voters.

Trump plan would steer foreign aid to ‘friends and allies’ | Foreign aid policy has long operated under the principle — at least in theory if not always in practice — that financial assistance should prioritize humanitarian need. | Trump has asked Congress to pass a law that effectively reorients U.S. aid to prioritize friendly countries, though there’s no sign lawmakers plan to do that. But the executive branch still has a fair amount of flexibility on the subject even though Congress is in charge of the U.S. budget. | The draft document does include some significant caveats. It states, for example, that the friends-only approach can be overridden if there are “overriding strategic, national security, or humanitarian concerns that require its continuation.” That means a country such as Egypt, which activists regularly slam for its poor human rights record, is likely to keep receiving large amounts of U.S. aid because it helps the U.S. counter terrorist groups and foreign adversaries in the Middle East. The draft document emphasizes the importance of countries eventually “graduating” off of U.S. foreign assistance completely. It argues for the need to leverage the private sector to help struggling states and the importance of evaluating aid programs to make sure they are achieving their goals. It is in many ways dismissive of multilateral institutions involved in aid. The document says the U.S. should move toward voluntary payments instead of required — or “assessed” — payments for certain U.N. bodies that “do not serve the interests of the United States,” though it does not say which. It also suggests shifting foreign aid to “bilateral channels as much as possible.” One directive in the draft could prove especially controversial. It states the U.S. should “end foreign assistance programs designed to address the supposed socioeconomic causes of terrorism.”

The chairman of the House Natural Resources Committee requested a government watchdog investigate additional details in its ongoing probe of the Interior Department’s new public records policy, which allows political appointees to review and potentially withhold documents from release. In a letter sent to the Interior’s Office of Inspector General (OIG) Friday, the committee asked for the OIG to additionally look into Interior’s Supplemental Awareness Review process. The internal policy, unearthed in a recent Freedom of Information Act (FOIA) release, allows Interior deputy solicitor Daniel Jorjani and deputy chief of staff Downey Magallanes five days to review all records requests related to senior staff in the secretary’s office before release. The supplemental review is in addition to the Interior’s Awareness Review process first put forth as early as May 2018. That policy allows any presidentially appointed, Senate-confirmed, non-career senior executive employees the ability to review FOIA requests related to them before they are released publicly.
Critics argue the policies allow political staff unprecedented input into the legitimacy of FOIA matches and that they could lead to documents being unlawfully withheld.

The Trump Administration Isn't Enforcing A New Policy To Speed Up Deportations, And Couldn't Tell A Judge When They Would | The administration had said it would start enforcing the new policy on Sept. 1. On Friday, a DOJ lawyer told a judge nothing had happened yet, and didn't have any details about when it would. | US District Judge Ketanji Brown Jackson in Washington, DC, is weighing whether to grant a request by the American Civil Liberties Union and immigrant advocacy groups that sued for an immediate injunction blocking the new policy while the case goes forward. The government is arguing that until immigration officers start enforcing the policy on the ground, any legal challenge is premature. At a hearing Friday, Jackson expressed surprise at DOJ's position, saying it would allow the government to adopt a policy to "scare" people, but avoid legal review by never actually acting on it. Jackson said she expected to rule in several weeks. In the meantime, she ordered the two sides to try to come up with a proposal by Sept. 10 to preserve the "status quo" while she writes her opinion — she had pitched, for instance, having the government notify her and the challengers as soon as someone was placed into expedited removal under the new policy. The judge expressed concern about the government suddenly starting to deport people without the court or challengers knowing.

House Democrats have taken their first formal steps to probe President Donald Trump’s alleged efforts to steer U.S. and foreign government business to his luxury resorts, part of an expanding roster of inquiries informing them whether to recommend of articles of impeachment. In a series of letters revealed Friday, the Judiciary Committee and Oversight Committee are demanding significant details about Trump’s call to host next year’s G7 summit at his own private resort — as well as Vice President Mike Pence’s recent stay at a Trump property in Ireland. The committees are seeking documents and details from the White House, the vice president’s office, the Secret Service and Trump’s private companies about efforts they say are likely to violate the Constitution’s prohibition on earning money from the U.S. or foreign governments. “Potential violations of the Foreign and Domestic Emoluments Clauses of the Constitution are of significant interest and grave concern to the Committee as it considers whether to recommend articles of impeachment,” House Judiciary Committee Chairman Jerry Nadler wrote to White House Counsel Pat Cipollone and Secret Service Director James Murray in a letter dated Sept. 5.

In early Spring of this year, an Air National Guard crew made a routine trip from the U.S. to Kuwait to deliver supplies. What wasn’t routine was where the crew stopped along the way: President Donald Trump’s Turnberry resort, about 50 miles outside Glasgow, Scotland. On previous trips to the Middle East, the C-17 had landed at U.S. air bases such as Ramstein Air Base in Germany or Naval Station Rota in Spain to refuel, according to one person familiar with the trips. Occasionally the plane stopped in the Azores and once in Sigonella, Italy, both of which have U.S. military sites, the person added. But on this particular trip, the plane landed in Glasgow — a pitstop the five-man crew had never experienced in their dozens of trips to the Middle East. The location lacked a U.S. base and was dozens of miles away from the crew’s overnight lodging at the Turnberry resort. Had the crew needed to make a stop in the U.K., Lakenheath Air Base is situated nearby in England. The layover might have been cheaper, too: the military gets billed at a higher rate for fuel at commercial airports. One crew member was so struck by the choice of hotel — markedly different than the Marriotts and Hiltons the 176th maintenance squadron is used to — that he texted someone close to him and told him about the stay, sending a photo and noting that the crew’s per diem allowance wasn’t enough to cover food and drinks at the ritzy resort.
