The bigger and more important issue is the Senate. Even if Dems win the presidency, if the Senate remains Red then the president will never be able to do anything. The Senate will block absolutely everything worse than they did with Obama. The President will never be able to nominate anyone ever and the Senate will just leave all the vacancies open.
